Terms and Conditions for Climax Nails LLC

These Terms and Conditions ("Terms and Conditions") govern the use of www.climaxnailsllc.com (the "Site"). This Site is owned and operated by Climax Nails LLC. It is an ecommerce platform.

By using this Site, you confirm that you have read, understand, and agree to abide by these Terms and Conditions at all times.

DISPUTE RESOLUTION NOTICE: THESE TERMS AND CONDITIONS INCLUDE A DISPUTE RESOLUTION CLAUSE THAT AFFECTS YOUR RIGHTS. PLEASE READ CAREFULLY.

Intellectual Property

All content on our Site is the property of Climax Nails LLC and its creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and any other material that contributes to the Site's composition.

Age Restrictions

The minimum age to use our Site is 16 years old. By using this Site, users affirm they are over 16. We do not assume responsibility for false statements about age.

Acceptable Use

Users agree to use our Site legally and not for illegal purposes. Specifically, users agree not to:

- Harass or mistreat other users;

- Violate the rights of other users;

- Infringe on the intellectual property rights of the Site owners or any third party;

- Hack into another user's account;

- Post inappropriate or offensive material.

We reserve the right to restrict, suspend, or terminate access to our Site if we believe you are using it illegally or violating these Terms and Conditions. We may also take legal action to prevent such use.

We reserve the right to suspend or terminate your account for illegal use or violation of these Terms and Conditions.

Sale of Goods and Services

These Terms and Conditions apply to the sale of goods and services available on our Site, including:

- Nail products and supplies.

- Nail services, classes, certifications, and other related services.

Services must be paid in full or a minimum 50% deposit to schedule an appointment.

Booking Policies

- We do not work over other technicians' work.

- Please arrive with bare nails and toes.

- Minimize the use of your cell phone during the appointment.

- All services booked and performed are non-refundable.

Deposit

A 50% non-refundable deposit is required at the time of booking to secure your appointment. This deposit will go towards your appointment. All payments made are non-refundable and non-transferable.

Payment Methods

- Cash: Please bring the exact amount or change.

- Apple Pay, Cash App, Venmo.

- Afterpay: A 6.5% convenience fee applies.

- Card payments are accepted.

- A 4% convenience fee applies for electronic payments.

Rules

- No extra guests allowed.

- No kids allowed.

- If you are sick, please let us know.

- No smoking is allowed.

- Masks are required.

Rescheduling/Canceling

- To avoid losing your deposit, you must cancel or reschedule at least 24 hours prior through your confirmation email.

- Same-day cancellation: $35 fee.

- Rescheduling on the same day: $35 fee. You can only reschedule your appointment once within 30 days. If you reschedule within 24 hours, the deposit and payments made in full expire within 30 days.

Extra Fees

- 15 minutes late fee: $15.

- After-hours service: $35.

- Day-of service request: $50.

- Holidays: $50.

Late Fee Policy

- 15 minutes late: $15 fee.

- 20 minutes late: Appointment canceled.

- No call no show: You will be charged 100% of the service booked and banned/blocked from booking again. To book a future appointment, you must contact us directly, and payment must be made in advance.

Secure Salon Policy

No extra people allowed.

Deposits

A non-refundable, non-negotiable deposit is required to book an appointment. Payments will be deducted from the total cost of the service. The remaining balance must be paid in cash or by card.

Late Policy

A $15 fee applies if you are more than 10 minutes late. If you are more than 15 minutes late, your appointment may be canceled, and the card on file can be charged the full price of the service.

Cancellations

Please notify us at least 48 hours in advance to cancel your appointment.

Rescheduling

You may reschedule your appointment at least 48 hours in advance, once within 30 days of the original appointment.

No Call No Show

If you fail to notify us or do not show up for your appointment, the full amount of the service may be charged, plus an additional fee for future appointments.

Travel Services

For travel services, including weddings, photo shoots, and house calls, please text us for more information. Travel requests must be for four people or more, and rates may vary.

Before or After-Hours Appointments

To schedule early morning or late-night appointments, text us (additional $30 fee applies).

Same Day Appointments

No Kids Allowed

Children are not allowed in the salon. If you bring a child, your appointment may be canceled or rescheduled, and you may be charged the full price of the service.

These Terms and Conditions apply to all goods and services displayed on our Site at the time of access.

All information, descriptions, or images of goods and services are as accurate as possible. However, we are not legally bound by such information as we cannot guarantee the accuracy of all provided details. You agree to purchase goods and services at your own risk.

We reserve the right to modify, reject, or cancel your order when necessary. If we cancel your order after payment, we will refund the amount paid. It is your responsibility to monitor your payment instrument for the receipt of any refund.

For Classes, Workshops, Paid Consulting, Mentoring, and Trainings

Cancellations

Notify us at least one week in advance to cancel your appointment.

Rescheduling

You may reschedule your appointment at least one week in advance, once within 30 days of the original appointment.

No Call No Show

If you fail to notify us or do not show up for your appointment, the full amount of the service may be charged, plus an additional fee for future appointments.

Third-Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of third-party goods and services.

Subscriptions

Subscriptions do not automatically renew. You will be notified before the next payment is due and must authorize it for the subscription to continue.

- Official Climax Nails LLC Gift Card (Not Expired)

By providing payment information, you authorize us to charge the amount due to your chosen payment instrument. If we believe your payment violates any law or these Terms and Conditions, we reserve the right to cancel or reverse the transaction.

Shipping and Delivery

Goods purchased on our Site will be delivered through various methods. Delivery times vary and do not include weekends and statutory holidays. You will not be charged for delivery.

Provide accurate delivery information. We are not liable for delivery issues resulting from inaccurate or incomplete information.

Refunds

We do not offer refunds of any kind.

Returns

We do not offer returns of any kind.

Consumer Protection Law

Where applicable consumer protection legislation cannot be excluded, these Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict, the mandatory provisions will apply.

These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania.

Dispute Resolution

If you and Climax Nails LLC cannot resolve a dispute informally, you agree to first try mediation, then arbitration if mediation fails. The arbitrator's decision will be final. Mediation or arbitration costs will be paid by the unsuccessful party. Both parties retain the right to bring an action in small claims court and for injunctive relief or intellectual property infringement.

Severability

If any provision of these Terms and Conditions is found to be invalid under applicable law, it will be deemed void and removed. The remaining provisions will remain valid.

Changes

We may amend these Terms and Conditions as necessary. Users will be notified by email or through a notice on our Site.
